Occupiers' Liability by Dr. Elaine Fahey,
BL
The Occupiers Liability Act 1995 was introduced to
radically restrict the rights of hill walkers and other
members of the public as entrants to lands and premises.
However its practical operation in the recent decade
has been far from radical and the dearth of caselaw
has created a level of uncertainty for advisers and
practitioners alike. This Paper discusses the impact
on occupiers liability resulting from important new
judgments ranging from the Circuit to Supreme Courts.
