Recent Developments in Irish Pensions Legislation
by Kirstie Flynn, Solicitor
Occupational pension schemes have seen a large number
of legislative changes in recent years. The Pensions
(Amendment) Act, 2002 overhauled the Pensions Act, 1990
and introduced new parts relating to the Pensions Ombudsman
and Personal Retirement Savings Accounts. The Social
Welfare and Pensions Act, 2004 brought in new equality
requirements for pension schemes. The IORPs Directive
of 2001 was implemented by the Social Welfare and Pensions
Act, 2005, bringing in major new trusteeship and investment
obligations. Meanwhile the Irish pensions law continues
to be updated on an at least annual basis. This paper
goes through the main legislative changes that have
impacted on pension schemes from 2002 to date.
