Recent Developments in Irish Pensions Legislation

Occupational pension schemes have seen a large number of legislative changes in recent years. The Pensions (Amendment) Act, 2002 overhauled the Pensions Act, 1990 and introduced new parts relating to the Pensions Ombudsman and Personal Retirement Savings Accounts. The Social Welfare and Pensions Act, 2004 brought in new equality requirements for pension schemes. The IORPs Directive of 2001 was implemented by the Social Welfare and Pensions Act, 2005, bringing in major new trusteeship and investment obligations. Meanwhile the Irish pensions law continues to be updated on an at least annual basis. This paper goes through the main legislative changes that have impacted on pension schemes from 2002 to date.

 

Speaker Bio

Kirstie Flynn is a pensions lawyer with Willis, having worked there since 1998. She qualified as a barrister in 1997. Kirstie is currently chairman of the Association of Pension Lawyers in Ireland, and was previously a member of the Legislation Committee of the Pensions Board. She is a contributing author of "Practical Employment Law".
