Workers with Disabilities by Michelle Ni
Longain, Partner in BCM Hanby Wallace
Employers in Ireland are increasingly faced with issues
in respect of workers who are disabled within the meaning
of our employment equality law, perhaps unknown to the
employer and possibly even to the worker. A lack of awareness
of the breadth of our definition of disability for employment
equality law purposes, the protection that the law gives
to workers and the obligations imposed upon employers
creates significant legal liability. This can result in
substantial awards of damages and orders that require
employers to introduce new policies and practices and
even to appoint unsuccessful candidates to positions,
with retrospective effect. This Paper discusses these
issues.
