The three most common types of proceedings that relate
to planning law are
(1) prosecutions for failing to comply with an enforcement
notice
(2) "planning injunctions"
(3) judicial review of planning decisions
This paper addresses these three actions. In relation
to the prosecutions, it sets out the proofs and possible
defences. As to the "planning injunctions," it sets
out the circumstances under which they can be obtained,
and what they can compel someone to do. As to judicial
review, it sets out the major differences between review
of planning decisions and review of other matters.
