The author outlines the changes to Irish employment
law wrought by the provisions of the Safety, Health
& Welfare at Work Act, 2005, amending the Safety, Health
& Welfare at Work Act 1989, and the specific duties
on employers and employees as a result. The standard
and duty of care as set out in the Act, is considered
in detail. Changes to directors' duties, the burden
of proof in proceedings and the regulation of agency
workers are considered, as are changes to the jurisdiction
of the courts and the fines that can be imposed by the
courts as a result of the Act of 2005.
