Despite its recent introduction, a growing mass of caselaw
on the European Arrest Warrant law, a judicial co-operation
procedure that has replaced extradition, has evolved.
The author outlines key decisions of the Irish Supreme
Court in respect of the European Arrest Warrant in Irish
law. The provisions of the European Arrest Warrant Act
2003 which purports to implement the Framework Decision
are outlined as they arise in the caselaw of the Irish
courts. Key caselaw in relation to fundamental rights
challenges, evidential challenges and access to justice
complaints are considered. The author considers the
effectiveness of s. 37 of the Act of 2003 in the Supreme
Court caselaw and the impact of the Pupino decision
of the Court of Justice is reflected upon.

Speaker Bio
Dr. Elaine Fahey LL.B (Dub.)., LL.M. (Cantab.), Ph.D
(Dub.) Attorney-at-Law (New York) Barrister-at-law (King's
Inns), is a graduate and Scholar of Trinity College
Dublin and Sidney Sussex College, Cambridge and an Assistant
Lecturer in law at the Dublin Institute of Technology,
Ireland. She has lectured and taught at Trinity College
Dublin and the Law Society of Ireland. She formerly
worked as a Judicial Research Assistant in the Judges'
Library Four Courts, Dublin. Her doctoral thesis is
in the area of Article 234 EC preliminary references
and she is the author of numerous publications in the
area including the forthcoming title Practice and Procedure
in Preliminary References to Europe: 30 years of Article
234 EC caselaw from the Irish Courts (Firstlaw, Dublin,
forthcoming), Irish Tort Legislation (Firstlaw, 2007)
and is the editor of the new monthly publication European
Law Update: European Regulatory and ECJ Developments
(Firstlaw, 2007).
