Stress and Bullying in the Workplace

It is now abundantly clear that employers owe duties of care to employees to provide reasonable protection in respect of stress and that failure to fulfil such duties of care can either justify an employee resigning and then claiming constructive dismissal, or alternatively can lead to an employee brining a personal injuries action against the employer. In many respects, however, these legal developments merely reflect the increasing level of awareness in both psychiatric and social terms of the nature of mental health and of the manner in which it can be threatened, often quite unpredictably, by what goes on the workplace.
